Information on the use of the Site

Any use of this Site provided by Aqua Lung GmbH is subject to the terms and conditions set forth below. In addition to or in place of them, other terms and conditions of use may apply to the purchase of products and/or services. Any use of the Site shall be deemed to constitute acceptance of these terms and conditions of use in their then current version.

  1. The content published on this Site is protected by copyright and special ancillary copyrights. Any use of this content shall require the prior written permission of the Provider or respective rights holder unless mandatory legal provisions stipulate otherwise. This shall apply in particular to the duplication, adaptation, translation, storage, processing, or reproduction of content in databases or other electronic media and systems. Third-party content and rights are indicated as such. The unauthorised duplication or dissemination of individual items of content or whole pages or the entire Site is not permitted and, in the event of wilful misconduct, shall result in criminal sanctions being imposed. Furthermore, content on this Site may not be distributed by the User to any third party at any time nor may it be leased or in any other way made available. This shall include the reproduction of this Site, in whole or in part, through framing (in particular “iframe”). Only the production of electronic copies and downloads for personal, private and non-commercial use is permitted. Personal use does not encompass use for publication, e.g. In social networks.

Should we become aware through communications or otherwise of any violations of the law, or if under general legislation we are obliged to remove or block the use of information, we will remove such content and/or links immediately.

  4. The Provider shall, when collecting, using and processing personally identifiable data of the User of the Site, comply with the applicable provisions of data protection law and the data protection provisions of the Provider.

  5. Any liability on the part of the Provider within the framework of use of this Site is excluded unless required by law on the basis of

  • wilful misconduct or gross negligence on the part of the provider, including wilful misconduct or gross negligence on the part of representatives or vicarious agents of the provider, or

  • injury to life, limb or health, 

  • the assumption of a quality guarantee, 

  • fraudulent concealment of a defect or

  • a breach of product liability law.

To the extent that no wilful breach of contract on the part of the Provider or its representatives or vicarious agents can be imputed, liability for losses or damage shall be limited to predictable, typical occurrences of damage.

6. The law and legislation of the Federal Republic of Germany shall apply, with the exception of the conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction shall be Singen if the User is a merchant within the definition of § 14 of the German Civil Code, a legal entity under public law or special fund under public law.

 

 Data protection

  1. For use of the Site and the provision of services, the Provider records various types of data, which are partly made available by the User and are partly necessary for use of the Site or arise from use of the Site.

  2. Data that the User makes available to the Provider:

    1. During login, for example via a login provider (e.g. with Facebook login), the basic data for login is transmitted by the respective login provider; the individual data are determined in each case by the login forms of the respective login provider and only collected, stored and used for use of the Site and its services. As part of such a login, the provider is also entitled to inform the user about changes, additions to or new versions of the Site and about the information provided via the Site as well as e.g. about competitions.

    2. If the User registers for use of a newsletter, this registration may take place via a login provider or through the provision of the e-mail address. The User is free to choose to provide further information when registering for the newsletter. The person registering explicitly consents to the dispatch of the newsletter to the e-mail address that is then specified.

    3. The data created by the User as a result of his use of the Site via a login provider is saved on servers of the provider but is not used or otherwise processed by the provider.

  3. Data that is collected directly during use of the Site

    1. When you visit the Provider’s Site and as part of the use of services, the Provider places one or more cookies – small files containing a string of characters – on the computer or other data processing unit of the User that uniquely identify the browser. The Provider uses cookies to improve the quality of the Site, including to save usage preferences and track user trends. When the User visits the Site or one of its sub-pages, the provider may place one or more cookies in the browser. The User can set the browser to inform him when a cookie is placed. The information that the cookie generates about your use of this Site is transferred to and stored on a server operated by Google in USA. We have activated IP anonymisation. On this Site, your IP address is therefore first abbreviated by Google within the Member States of the European Union or in other States which are party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a server operated by Google in the USA and abbreviated there. Users of our Site on which the Facebook plug-in (“Like” button) is installed are hereby notified that the plug-in creates a link to Facebook via which communication to your browser is effected so that the plug-in appears on the Site. Furthermore, use results in data being forwarded to the Facebook server, which includes information regarding your Site visits on our homepage. For logged-in Facebook users, this results in the use data being assigned to your personal Facebook account. As soon as you, as a logged-in Facebook user, actively use the Facebook plug-in (e.g. By clicking the “Like” button or using the comment function), this data is transferred to your Facebook account and published.
